| I am hoping this is not what I think it is. However it is my understanding that the days when an adult male or female who serve our Country could buy for example PLAYBOY on a military installation are about to end. In this time of War seems as though this is an important issue to some of our lawmakers.Not bringing them home,not taking care of the them. Say it ain't so! Please tell me that I really don't understand! Please tell me the Republicans are not behind this! Or are they? Please tell me that being 18 years of age allows you to die for your country but not only can't you drink before you die you now can no longer read or view what pleasures you the night before you die! Congressman Broun Introduces Anti-Pornography Legislation Broun: “The ‘Military Honor and Decency Act’ will right a bureaucratic--and moral--wrong.” Washington D.C.- U.S. Congressman Paul C. Broun, M.D. announced today the introduction of legislation designed to stem the sale of pornography on military installations. Broun’s legislation, the “Military Honor and Decency Act,” closes a loophole in current law that is allowing the sale of sexually explicit material on American military installations located both within the United States and around the world. Although the “National Defense Authorization Act of 1997” expressly prevents the Secretary of Defense from permitting the sale or rental of sexually explicit material on property under the jurisdiction of the Department of Defense (DoD), subsequent regulations adopted by the Department of Defense have continued to allow the sale of sexually explicit material to occur. Congressman Broun’s legislation closes these existing loopholes in DoD regulations to bring the Department into compliance with the intent of the 1997 law so that taxpayers will not be footing the costs of distributing pornography. MUST READ “As a Marine, I am deeply concerned for the welfare of our troops and their mission,” said Broun. “Allowing the sale of pornography on military bases has harmed military men and women by: escalating the number of violent, sexual crimes; feeding a base addiction; eroding the family as the primary building block of society; and denigrating the moral standing of our troops both here and abroad. Our troops should not see their honor sullied so that the moguls behind magazines like Playboy and Penthouse can profit. The ‘Military Honor and Decency Act’ will right a bureaucratic--and moral--wrong.” That was too much REALLY! Congressman Broun’s legislation makes the following specific changes to current law: · Modifies the current definition of sexually explicit, to lower the threshold required to deem material sexually explicit. · Adds a new definition of “principal theme” which makes it clear to the DoD that the threshold has been lowered. · Adds a definition of “lascivious” that is broader than what is included in the DoD Instruction on the sale of sexually explicit material. · Adds a definition of “nudity” that makes it much more difficult for the DoD’s Resale Activities Board of Review (RABR) to approve the sale of sexually explicit material. · Requires that DoD annually review material that is not currently deemed sexually explicit (and therefore allowed) to determine if it should be prohibited. RABR failed to meet a single time between FY 2000 and 2005. Congressman Broun’s legislation is officially designated as H.R. 5821 and has already attracted 15 cosponsors. 110TH CONGRESS 2D SESSION H. IN THE HOUSE OF REPRESENTATIVES Mr. BROUN of Georgia introduced the following bill; which was referred to the Committee on llllllllllllll A BILL To amend title 10, United States Code, to close loopholes in the prohibition on the sale or rental of sexually explicit material on military installations. 1 Be it enacted by the Senate and House of Representatives of the United 2States of America in Congress assembled, 3 SECTION 1. CLARIFICATION OF PROHIBITION ON SALE OR 4 RENTAL OF SEXUALLY EXPLICIT MATERIAL 5 ON MILITARY INSTALLATIONS. 6 Section 2495b of title 10, United States Code, is 7 amended— ........................ 1.. (1) by redesignating subsections (c) and (d) as 2.. (d) and (e), respectively; 3.. (2) by inserting after subsection (b) the fol 4..lowing new subsection: 5.. ‘‘(c) ANNUAL REVIEW OF MATERIALS.—At least an 6..nually, the Secretary of Defense shall review material that 7.. is not deemed to be sexually explicit to determine if such 8.. material should be deemed sexually explicit and thus pro 9..hibited by this section.’’; 10.. (3) in subsection (e) (as redesignated)— 11.. (A) by amending paragraph (1) to read as 12.. follows: 13.. ‘‘(1) The term ‘sexually explicit material’ 14.. means— 15.. ‘‘(A) an audio recording, a film or video 16.. recording, or a print publication with visual de 17..pictions, produced in any medium, a principal 18.. theme of which depicts or describes nudity or 19.. sexual or excretory activities in a lascivious 20.. way; or 21.. ‘‘(B) if the print publication is a periodical, 22.. it regularly features or gives prominence to nu 23..dity or sexual or excretory activities.’’; and 24.. (B) by adding at the end the following new 25.. paragraphs: ............... 1.. ‘‘(3) The term ‘principal theme’ means a theme 2.. that is primary in importance, influence, attraction, 3.. or degree but not necessarily dominant relative to 4.. other themes in the material. 5.. ‘‘(4) The term ‘lascivious’ means lewd or inde 6..cent and intended, designed, or given to elicit a sex 7..ual response. 8.. ‘‘(5) The term ‘nudity’ means human genitals, 9.. pubic area, anus, anal cleft, or any part of the fe 10..male breast below a horizontal line across the top of 11.. the areola with less than an opaque covering but 12.. does not include the exposure of the cleavage of the 13.. female breast exhibited by a dress, blouse, bathing 14.. suit, or other apparel.’’.
